Pro-Wike lawmakers lose bid to halt sack

A Court of Appeal in Port Harcourt on Friday ruled against the appeal filed by the 26 former members of the Rivers State House of Assembly to stay execution of the order barring them from parading as Lawmakers after their defection to the All Progressives Congress (APC).

The Court of Appeal, Port-Harcourt at a virtual hearing on Friday via Zoom gave its ruling on two motions filed by Martins Amaewhule and the other defected lawmakers challenging the order of injunction granted by the Rivers State High Court restraining them from acting as lawmakers.

The court in ruling on the first motion, granted the appellants’ prayers for leave to compile and transmit the records of appeal, deeming the appellants’ brief of argument as filed, accelerated hearing and a stay of further proceedings at the High Court.

The Court of Appeal, however, refused to grant the prayer for a stay of execution and setting aside the interim order of the lower court. It held that granting same would be tantamount to determining the appeal at this stage. The Court went on to order that the present status quo should be maintained pending the hearing of the appeal.

Ruling on the second motion which was brought to set aside the interlocutory injunction of the Lower Court, the Court of Appeal also refused the prayer, and reiterated that the ‘present’ status quo should be maintained.

The respondents are to filed their briefs within 72 hours of being served. The case has been adjourned to 20/6/24 for hearing of the appeal.

The presiding Judge, Justice Hamma Akawu Barka stated that: “I have looked at the peculiar nature of the instant case, and do agree that guided by the decisions of Ediru vs. Tijjani (2024) SNWLR (pt. 1931) 393 at 416, and pursuant to the stipulations of Order 4 Rule 4, it is just that parties halt hostilities until the determination of the Appeal before this court.

“In consequence therefore, all parties are ordered to maintain the present status quo pending the determination of the appeal before the court.

“I have equally studied prayers 6, 8 — 11, prayed for by the applicants.

“A critical study of the prayers deals with the substance of the issues on appeal, and dealing or granting the same will be tantamount to determining the issues on appeal at this interlocutory stage, which this court will decline to do.

“The conclusion is that the application succeeds in part. Prayers 1, 2, 3, 4 and 7 are granted, while all other prayers stand not granted. I make no order on costs.”

The appeal by the applicants according to the court, was brought on the grounds that: “On the 10 of May, 2024, the Rivers State High Court sitting at Port Harcourt coram; Honourable Justice C. N. Wali wherein it granted exparte orders of injunction in suit no: PHC/1512/CS/2024 between Rt. Hon. Victor Oko Jumbo and Ors. V. Hon. Martin Chike Amaewhule and Ors.

“In the ruling referred to in paragraph (i) above, the learned trial judge inter-alia restrained the appellants from parading themselves as members of the Rivers State House of Assembly. The appellants have lodged an appeal against the ruling of the Rivers State High Court to this honourable Court.

“The Appellants/Applicants contend inter alia in this appeal that the said exparte orders of interim injunction in the ruling appealed against were made without jurisdiction on part of the trial court being appealed on Is correct until the contrary is proved. See, Martins vs. Nicannar Food Company Ltd (1988) 2NWLR (pt. 74) 75. Applicant must also establish that the balance of convenience weighs in his favour. See, NNPC vs. Famfa Oil Ltd (2009) 17NWLR (pt. 1328) 148.”

World Bank approves $2.25bn to support Tinubu’s economic reforms

The Minister of Finance and Coordinating Minister of the Economy, Mr. Wale Edun yesterday announced the approval of two major financial support packages by the World Bank.

He said it is part of President Bola Tinubu’s ongoing efforts to stabilize the economy, reposition it for sustained and inclusive growth, and provide urgent support to the poor and vulnerable.

In a statement, Mohammed Manga, Director, Information and Public Relations said “the approved operations include $1.5 billion for the Nigeria Reforms for Economic Stabilization to Enable Transformation (RESET) Development Policy Financing Program (DPF) and $750 million for the Nigeria Accelerating Resource Mobilization Reforms (ARMOR) Program-for-Results (PforR).”

He stated that “This combined total of $2.25 billion will offer essential financial and technical support as the government continues to address economic distortions.

“Additionally, it will assist Nigeria in its long-term goal of increasing non-oil revenues and securing oil revenues to ensure fiscal sustainability and the delivery of quality public services.”

Upon assuming office, the Federal Government was confronted with significant economic challenges, and recognized the need for urgent reforms to correct the economic imbalance and strengthen Nigeria’s financial outlook.
Initial critical steps have been taken to restore macroeconomic stability, boost revenues, and create the conditions necessary to reignite growth and reduce poverty.

These ongoing measures are part of a broader strategy to increase revenues, create jobs, and foster sustainable economic growth.

He said Mr. Wale Edun has welcomed the support of the World Bank and emphasized the necessity for the reforms:

“We have undertaken bold and necessary reforms to restore macroeconomic stability and put Nigeria on a path to sustainable and inclusive economic growth.

“These reforms will create quality jobs and economic opportunities for all Nigerians. We welcome the support of the RESET and ARMOR programmes as we further consolidate and implement our policy reforms, consistent with accelerating investment and using public resources more sustainably to achieve our development goals”.

Ousmane Diagana, the World Bank Vice President for Western and Central Africa, praised Nigeria’s efforts: “Nigeria’s comprehensive macro-fiscal reforms are placing the country on a new path that can stabilize the economy and lift people out of poverty. It is essential to maintain the momentum of these reforms and continue to provide support to the poor and vulnerable to mitigate the impact of the cost-of-living crisis.

“This financing package strengthens the World Bank’s strong partnership with Nigeria and supports efforts to rejuvenate the economy and expedite poverty reduction, serving as an example for Africa”.

Manga said, “Focus areas of the programmes include RESET DPF, which aims to strengthen Nigeria’s economic policy framework, create fiscal space, and protect the poor and vulnerable, and ARMOR PforR, which supports tax and excise reforms, improves tax revenue and customs administration, and safeguards oil revenues.”

Prison decongestion: FG begins audit of inmates in 256 custodial centres

The Federal Government has commenced nationwide audits of inmates across the 256 custodial centres to enable it to carry out decongestion of the facilities.

Minister of Interior, Dr Olubunmi Tunji-Ojo, made this known after he undertook an inspection of the ongoing 3,000-capacity Maximum Security Custodial Centre in Janguza, Kano State as well as the Medium Security Custodial Centre in Kuje, Abuja.

He hinted that the government has planned a massive decongestion of the custodial centres, saying this could only be possible after the nationwide audit is carried out.

Tunji-Ojo also noted that there is ongoing rehabilitation of the custodial centres, disclosing that a lot of the correctional facilities were inherited from the Colonial administration, requiring reconstruction to make them transformational centres.
The Minister also revealed that work is ongoing on the Suleja Custodial Centre while a manhunt is still on to recapture the few remaining fleeing inmates.

Tunji-Ojo said: “That is ongoing but the good thing for me is that we did a facility audit earlier and we can see that the result of the facility audit is how we are intervening.

“So, we are very empirical and scientific in our approach. We don’t just throw solutions to problems that are unknown. We discover the problems, we know the root cause of issues, then we find solutions to them.

“So, the audit system is being empirical. It is scientific and that will lead massively to the decongestion of our custodial centres. It is not just saying you want to decongest, it is about you knowing the status.

“Life is all about data. Data is the new oil. Data is the blood of life in this millennium. The audit is going on and by the time we are done with the audit, you will see the level of decongestion that we will have as a result of the audit. So, we are just being empirical,” he said.

According to a statement, the minister at the Kuje facility got a gift of three books authored by one of the inmates who had been in custody for the past 12 years.
Tunji-Ojo who was excited by the development, said the facilities are no longer prisons but correctional centres for reforming the legally interned.

“Obviously, Renewed Hope is on course. President Bola Tinubu is working on our Custodial Centres and not to forget, a young man, one of the inmates today gifted me about three books authored by him.

“He has been here for like 12 years and today he has finished his first degree through the National Open University of Nigeria NOUN, he has finished his Masters Degree and is about enrolling for his PhD.

“That is the positive story about Nigeria that I want people to see. This shows that our Custodial Centres are no longer ‘Prisons’. They are now correctional. They are transformational.

“They are reformatory institutions and Nigerians can know that the Renewed Hope Agenda is not just about the strongest in the society. It is about both the strongest and the weakest in our society,” he said.

Earlier, the government had begun the process of decongesting Kuje Custodial Centre, following a jailbreak that took place in the centre.

Besides, the government is considering the construction and fortification of Karshi Correctional Centre to prevent the reoccurrence of jailbreaks in Kuje and Suleija custodial centres.

”Therefore, any form of sexual exploitation and abuse will be met with severe consequences.

“As ambassadors of the armed Forces of Nigeria and our great nation, you must uphold the esteemed values and enviable image of this country,“ Sinjen said.

“This graduation is a testament to the capacity and capability of the MLAILPKC as a United Nations accredited Centre to conduct quality training of prospective peacekeepers for deployment to multidimensional Peace Support Operations in fulfilment of her mandate.

“The Centre has within the last six weeks been able to train, retrain and refresh the troops on requisite knowledge and expertise to succeed in a Peace Support Operation environment.

”It is my fervent belief that these men are better informed and equipped to perform their roles in the Gambia,“ Adedoja said.

He said the graduation ceremony once more showed the commitment of Nigeria and the Nigerian Armed Forces to global peace and security.

It showed that it was not done by an engineer because of inconsistencies and corruption. I want to know why that was done, as it contributed to the failure of that project.

The command’s anti-kidnapping team intercepted the bus, which was found to be carrying water treatment chemicals after the driver attempted to evade arrest.

According to sources, Aro, the plumber employed by the ministry, is accused of duplicating the key to the ministry’s storage facility in order to facilitate the theft.

During the investigation, detectives discovered that the suspects had already stolen 50 bags of chemicals before being intercepted during their third trip.

The Public Relations Officer of the state police command, Toun Ejire-Adeyemi, confirmed the incident yesterday.

According to her, “Some suspects are being held in connection with the stolen water treatment chemicals.

“25 bags of the items were retrieved from them as of the time of the arrest. The command is still on the trail of other suspects fingered in the alleged theft.”

Court Grants Social Media Influencer, Ijele ₦50Million Bail

Chizorom Harrison Ofoegbu

A Federal High Court sitting in Lagos State has granted bail to social media influencer Chizorom Harrison Ofoegbu, popularly known as Ijele.

The bail was granted in a ruling delivered by the trial judge, Justice Akintayo Aluko yesterday.

Ijele was ordered by the court to present a ₦50 million bail bond, with the condition that one surety possesses land in Lagos and the other holds a civil service position of no less than level 14.

Recall that the Lagos State Police had invited the social media influencer for questioning days after accusing popular pastor, Evangelist Ebuka Obi of conducting fake miracles.

The Police Force, however, filed an amended three-count criminal charge against Ijele before the court.

Chizorom Harrison Ofoegbu

The three counts in the case between the Inspector General of Police as the complainant and Chizorom Harrison Ofoegbu as the defendant involve conspiracy, criminal defamation, cybercrime, and threats to life.

In the charge numbered FHCA/3210/24, the police said the offences violate sections 24(1)(a)(b), (2)(a)(b); 27(1)(a) of Cybercrimes (Prohibition, Prevention) Act 2015 and sections 373 and 374 of the Criminal Code Act, Punishable under section 375 of the Criminal Code Act.

Also, a magistrate’s court in Abuja had previously dismissed the case related to criminal intimidation, threats to life, cyberstalking, and cyberbullying filed against him.

Chief Magistrate Emmanuel Iyanna, while ruling on the bail application filed through the defendant’s lawyer, struck out the case for lack of jurisdiction.

The judge also instructed the police to bring the blogger before a competent court of law so that the defendant can enter a plea in accordance with the provisions of the Administration of Criminal Justice (ACJA) 2015.

The Nigeria Police Force is prosecuting the case on behalf of Evangelist Ebuka Obi’s Zion Prayer Ministry Movement Outreach.

Rainstorm destroys buildings in Plateau hospital

A rainstorm in the early hours of Friday wreaked havoc in the Plateau State Specialists Hospital in Jos, the state capital, rendering doctors and other health officials stranded.

This came even as the hospital yesterday took delivery of 100 beds and 100 mattresses purchased for patients’ use by the Governor Caleb Mutfwang-led administration.

The Chief Medical Director of the hospital, Prof Christopher Yilgwan, confirmed the development in a chat with newsmen.

He said the doctors and other health officials affected by the rainstorm had been evacuated to other locations for safety.

The CMD said, “As we are receiving the good news (purchase of 100 beds and 100 mattresses) , we woke up this morning to find out that the whole block where some doctors and house officers are staying have been destroyed by rainstorm. As we speak, all of them have been stranded and displaced and their properties destroyed.

“But we have informed Governor Caleb Mutfwang and, in his usual magnanimity, has provided a temporary abode for them while we have a comprehensive estimate of the damaged facilities and submit for renovation and I can assure you that all hands are on deck to see that we address the problem.”

The CMD, who described the incident as unfortunate, added that Plateau hospital caters for more than 60 % of the people in town, including those within the lower realm.

He noted that most of the infrastructure and facilities in the hospital which were built several decades ago had become obsolete and needed to be changed for optimum service delivery.

“We have migrated to an e-hospital system to manage all hospital operations in an electronic manner. That helps us with accurate data to plan appropriately because before now, most of what we do is guesswork. We have also restored the water network in the hospital such that patients don’t have to walk carrying water on their heads. There is a plan to rebuild the hospital to a new specialist hospital.

“Already, architectural designs have been finished and structural designs have also been concluded and we are only waiting for the simulation exercise, and in no distant time, we will reposition the hospital to serve the people better in line with the promise of the present administration,” the CMD added.

Appeal Court voids Yahaya Bello’s contempt case against EFCC boss, Olukoyede

The Court of Appeal in Abuja has quashed the contempt case initiated by the immediate past Governor of Kogi State, Yahaya Bello, against the Chairman of the Economic and Financial Crimes Commission (EFCC), Olanipekun Olukoyede.

Bello had predicted the contempt case before a High Court of Kogi State sitting in Lokoja on interim orders earlier granted by the court, subsequent upon which the High Court ordered Olukoyede to show cause why he should not be held for contempt, a decision the EFCC boss appealed.

In a judgment on Thursday, June 13, a three-member panel of the Court of Appeal held among others that the contempt case was premised on dead interim orders issued by the Kogi State High Court, sitting in Lokoja.

The Court of Appeal held that, as at the time Bello commenced the contempt case, the interim orders, on which the contempt case was built, had expired because the High Court had delivered its judgment on the substantive fundamental human rights enforcement suit filed by Bello.

It noted that the interim orders, having been made pending the determination of the substantive suit and the substantive suit having been determined without the lifetime of the interim orders extended in the final judgment, the interim orders were extinct as of when the contempt case was initiated.

In the lead judgment, Justice Joseph Oyewole held the trial judge failed to extend the interim orders of 9/2/2024 in its final judgment of 17/4/2024.

The court awarded N1 million cost against the respondent (Bello).

Corporal who promoted self to superintendent arrested in Calabar

A police corporal, Buba Adamu, who was transferred from Cross River State Command to Kaduna State Police Command in 2015, refused to report but promoted himself to the rank of superintendent.

He was alleged to be using the uniform and rank of SP to carry out illegal activities in Calabar, the Cross River State capital.

The suspect has been operating as a “Mobile Police Officer” without reporting to a specific police command since 2015.
The state police command effected his arrest and has been in detention.

The state Police Public Relations Officer, SP Irene he Ugbo, confirmed Adamu’s detention.

“It is true that the said officer was transferred from Cross River to Kaduna State in 2015, and no one knew he didn’t report at his new station ever since.

“There are allegations that he has been carrying out criminal activities around Bacoco, Nassarawa area of Calabar. All these will be investigated with a view to prosecuting him.”

Findings confirmed that Adamu has since been drawing his monthly salary, even though he never reported at his new station.

Concerned members of the Nassarawa community, a Hausa/Fulani settlement in Calabar tipped off the police about Adamu’s illegal activities in their neighbourhood.

They caution the police not to release Adamu despite pressure because their lives would be at risk.

Soludo warns Tinubu against approving ‘unsustainable’ minimum wage

Governor Chukwuma Soludo of Anambra state has warned President Bola Tinubu against approving “unsustainable” minimum wage for workers in the country.

Speaking at a special edition of (The Platform), an event organized by The Covenant Nation to promote national development, Soludo delved into the complexities of the minimum wage debate and its broader economic implications.

The former Governor of the Central Bank of Nigeria (CBN) warned that not all state governments and the Organised Private Sector can pay the ₦62,000 being proposed by the Federal Government and the ₦250,000 demand of the Organised Labour.

Governor Soludo cautioned that adopting an unsustainable wage could lead to job losses and further economic challenges.

Recall in his Democracy Day address on Wednesday, Tinubu assured Labour that an executive bill on the new national minimum wage for workers would soon be sent to the National Assembly for passage.

The President would make a decision on the ₦62,000 proposal of the government and private sector side; and the ₦250,000 demand of the Organised Labour.

“If you share it to all Nigerians, it comes to ₦6,160 per person, per month, per capita. If you take even the total ₦28. 7 trillion (budget) and share, it will come down to ₦10,000 per capita,” he said.

He argued that the private sector employs a huge percentage of the total workforce in the country and not all of them can pay the ₦62,000 proposed by the Federal Government.

Soludo said he spoke with nine entrepreneurs in his state and none of them could pay the proposed amount by Labour.

The Anambra governor said, “The minimum wage thing, everybody is right. The worker is right to say, ‘What am I getting?’ Nobody is asking what does a worker do? We are not asking that question yet. All we are saying is: ‘How much does he need?’ He (the worker) is right, and for me, even if we pay N1 million, it’s not enough.

“But on the other hand, you have to come back to reality; talking about these MSMEs, the schools, churches, so on and so forth. You will have to pay your own driver. We are all in it. Whatever they agree, we will muddle through but may be after one year, we will need to meet to discuss the consequences.”

“I pity the President because it will all be on his head if the consequences come down, whatever it is, if whatever is negotiated is unsustainable or payable or whatever. Months to come, who will bear the responsibility? Not me.”

LG autonomy: Supreme Court reserves judgement on FG’s suit against 36 govs

The Supreme Court has reserved its judgement on the suit the Federal Government filed to secure full autonomy for the 774 local governments, , in the country.

A seven-man panel of the court, led by Justice Garba Lawal, on Thursday, okayed the matter for judgement. This was after governors of the 36 states of the Federation, through their respective attorney-generals, adopted their briefs of argument.

The states, in separate preliminary objections they filed before the apex court, sought the dismissal of the suit with substantial cost.

They contended that the Attorney-General of the Federation and Minister of Justice, Prince Lateef Fagbemi (SAN), who initiated the action on behalf of the Government, lacked the locus standi (legal right) to do so.

The defendants further alleged that the AGF breached their right to a fair hearing when he failed to serve them with a copy of a further affidavit he filed in support of the suit.

Besides, some of the states argued that they already have democratically elected local government officials in place. They insisted that the suit by FG amounted to an abuse of the judicial process.

After it had listened to all the parties, the Justice Lawal-led panel said it would communicate the judgement date to them.

The Federal Government had in the suit marked SC/CV/343/2024, prayed the Supreme Court to okay full autonomy for all the local governments, , in the country as the third tier of government.

It prayed the court to issue an order, prohibiting state governors from embarking on unilateral, arbitrary, and unlawful dissolution of democratically elected local government leaders.

As well as for an order permitting the funds standing in the credits of local governments to be directly channelled to them from the Federation Account in line with the provisions of the Constitution as against the alleged unlawful joint accounts created by governors.

Besides, FG prayed the Supreme Court for an order stopping governors from further constituting caretaker committees to run the affairs of local governments as against the constitutionally-recognized and guaranteed democratic system.

It equally applied for an order of injunction, restraining the governors, their agents and privies, from receiving, spending or tampering with funds released from the Federation Account for the benefit of local governments, when no democratically elected local government system is put in place in the states.

FG argued that Nigeria, as a federation, was a creation of the 1999 Constitution, as amended, with the President, as Head of the Federal Executive Arm, swearing on oath to uphold and give effects to provisions of the Constitution.

Meanwhile, the Supreme Court, on Thursday, rejected applications that Speakers of Houses of Assembly of some of the states filed to be joined as interested parties in the LG autonomy matter.

Coalition of ethnic nationalities calls for restructuring of Nigeria

The Coalition of Indigenous Ethnic Nationalities (CIEN) has said that it has taken cognizance of the fact that our faulty socio-political and socio-economic structures were traceable to the 1999 Nigeria Constitution and believed that the call for the restructuring of the Nigerian Federation is germane and an idea whose time has come.

This was contained in a statement signed by Prof. Benjamin Okaba, Chairman, CIEN, Mr. Timothy B. Gandu, Co-Chairman, CIEN and Mr Nubari Saatah, Secretary, CIEN issued to journalists in Kaduna yesterday.

The Coalition congratulated Nigerians and the Nigerian state on Democracy Day, “as we commemorate our silver jubilee of unbroken democratic rule. This year’s Democracy Day, more than any other, calls for sober reflection and introspection by Nigerians, and most especially its political leadership.”

“Twenty-five (25) years after Nigeria’s political trajectory changed from the path of guns, khakis and jackboots in a military dictatorship, to political parties and a voting public in a civilian democracy, the hope that this change first rekindled and inspired in Nigerians on May 29th 1999, has slowly but steadily degenerated into palpable despair as a result of Nigeria’s visible socioeconomic and sociopolitical decay,” the Coalition said.

The Coalition explained further that “this slow degeneration of the Nigerian Federation is manifested in more ways than one, but encapsulated in the following: the budding secessionist movements that have sprung up in different sections of the country over the years and now threaten its unity; the rise in religious and ethnic intolerance; insurgency and terrorism which have ravaged and continue to ravage different parts of the country; a gradual socioeconomic decline with a ripple effect of impoverishing a larger percentage of the Nigerian population, with a grossly skewed graph of the distribution of the common wealth; and last but not the least, a decline in Nigeria’s sociopolitical status within the comity of nations on the African continent and the wider international stage. These and many more have brought us to a head as a people.”

“Today, more than at any point in Nigeria’s history, calls for the urgent restructuring of the country have been at their loudest, and continue to reverberate. While we believe that Nigeria has grappled with poor leadership for most of its history, and that this has contributed immensely to our current state, the Coalition of Indigenous Ethnic Nationalities has taken cognizance of the fact that our faulty socio-political and socio-economic structures are traceable to the 1999 Nigeria Constitution. We therefore believe that the call for the restructuring of the Nigerian Federation is germane and an idea whose time has come.”

“Mindful of the above, CIEN, in living up to its founding mandate of uniting Nigeria’s indigenous ethnic nationalities as a means towards fostering mutual understanding and cooperation, the protection of our various and collective interests, self-determination, and the advancement of the Nigerian state in general, have since its founding, been engaging with the indigenous peoples on the way forward for our people and we have been largely successful in this regard.”

“It is on this note that CIEN would like to inform the Nigerian public and its political leadership, that after due deliberations and consultation on the restructuring of the Nigerian Federation, we have put together recommendations and templates which we strongly believe if and when implemented, will serve to steer Nigeria away from a more tumultuous immediate future, and towards a more prosperous future where the hopes and aspirations of the indigenous ethnic nationalities will be actualized.”

Pardon imprisoned EndSARS protesters — Shehu Sani tells Tinubu

A former senator representing Kaduna central, Shehu Sani has called on President Bola Tinubu to pardon the EndSARS protesters, who are still in detention.

Sani made this call while speaking at a dinner marking the 2024 Democracy Day Recall that many Nigerian youths protested across the country against the excesses of the now-disbanded special anti-robbery squad (SARS) unit of the police in October 2020.

After a series of protests, many protesters were arrested in cities such as Lagos, Rivers, and Ibadan, some of whom have remained in detention.

Reacting to the development, Sani said the Nigerian youths who protested against the SARS took after Tinubu, who, according to him, was at the forefront of the struggle for the return of civilian rule in the country.

He said, “Mr. President, there are some people who are still in detention as a result of EndSars’ protest. They were young people who were protesting for justice, freedom, and democracy,” Sani said at the event attended by Tinubu.

“Any young protester in Nigeria today should learn from you because you were the father of protest in Nigeria. Do something about it. Give them the freedom; give them the pardon.”

“You taught us; you funded us to stand up and fight. So, they are your children and grandchildren; give them pardon.”

The former senator also urged Tinubu on the need to foster freedom, equity, and justice in the country.

“Mr. President, I would like to draw your attention. A national anthem cannot unite a nation. A national pledge or a constitution cannot unite a nation.

“A nation is united by the ideals of freedom; a nation is united by equity and justice. Many younger generations of today have not and couldn’t know the sacrifice we have made to restore democracy to this country.

“It is important that we bring attention to those who were not here in those days of struggle.

“Democracy wasn’t a gift given to us by the military. It wasn’t a lottery that we won. It was a product of struggle and sacrifice. There were people forced into exile, like the president and commander-in-chief of the armed forces and the likes of Wole Soyinka.

“There were people who were sent to prison like us. We are supposed to spend the first 15 years of our lives in prison, but by the magnanimity of God, we were out. There were many who were dead. This democracy is a product of struggle.

“The Academic Staff Union of Universities made sacrifices, and the media made sacrifices. The NUPENG, headed by the likes of Frank Kokori, made sacrifices, and the National Association of Nigerian Students made sacrifices.

“This democracy was a product of that struggle, a product of determination, and a product of sacrifices.

“Mr. President, you have a duty to succeed. If you succeed, we will share your glory because you came from the trenches, that period of struggle. Mr. President, if you fail, they would say those of you who fought for democracy have nothing new to offer to Nigeria.”

Simon Ekpa must be arrested, prosecuted – Defense Chief Musa vows

The Chief of Defence Staff, General Christopher Musa has wowed that Simon Ekpa, self-proclaimed Prime Minister of the proscribed Indigenous People of Biafra (IPOB) must be arrested and prosecuted.

Musa made this vow in an interview with newsmen.

The Chief of Defense Staff accused Finland of shielding Simon Ekpa.
He decried the activities of IPOB in the South-East, demanding the arrest and prosecution of Ekpa.

The CDS called on the Nigerian government to take decisive action, including exploring diplomatic options to curb the menace of the factional leader of the IPOB.

He said, “We have repeatedly complained about the issue of Simon Ekpa. He is in Finland and the Finnish Government is giving him all the support and he is doing what he is doing.

“The comments he is making, people are being killed and nothing is being done. This is democracy. If the European Union is supporting democracy and this is happening and they are not taking action, then they don’t mean well for Nigeria.

“We have said that in clear terms. We need to diplomatically find means of getting him out of whatever it is that he is doing. He must be arrested, he must be prosecuted.

“Look at it from the other way, assuming he is in Nigeria, he is doing that to the Finnish government, you think the European Union will allow that to happen? They definitely will not.”

Speaking on the deradicalisation initiative by the military for repentant terrorists in the North-East, Musa said it is yielding the needed results.

Musa said, “It is working very well. I was the commander when it started, we were the ones that started it and every process that we did, we worked together with the state because the state had the authority on the ground.

“Before it started and they were willing to surrender, the states were the ones that took the mantle and we followed up.

“Everyone that surrendered came first to the security forces that were closest to them. They were disarmed, and we got the DSS to profile them.

“The state government provides the administration of those people and we took them to their camps. We were able to separate them and realised that not all of them were combatant. Some were forced, and some were used as labourers.

“The main ones that were the actual operators were kept separately, working together with the victims,” he said.

Court sentences pastor to life imprisonment for sedating, defiling minor

Court

The High Court of Ekiti State, sitting in Ado Ekiti and presided over by Justice O.I.O Ogunyemi on Thursday convicted and sentenced to Life imprisonment a pastor of Winner Chapel Church situated at Omuo- Ekiti, Enoch Gbinyiam on a lone count offence of Rape of a minor.

The survivor who is the daughter of one of his church members was said to have been raped by the pastor in one of her visits to the vicarage.

The innocent survivor of the rape usually frequented the mission house to help the wife of the Pastor with house chores, teach and help his young children in their school assignments.

It was during one of her visits to the vicarage that the convict offered her a sedated bottle of Fanta. The poor girl took the Fanta and slept off and woke up to find herself bleeding profusely from her vagina.

The convict was arrested and charged to Court. He was charged with the offence of Rape contrary to section 2 of the Gender–Based Violence (Prohibition) Law, 2019.

The learned Director of Public Prosecutions, Julius Ajibare, who prosecuted the case for Ekiti State called 4 witnesses and tendered 2 Exhibits to float his case.

The convict who spoke through his counsel, Adeyinka Opaleke, gave evidence in his defence and called one other witness.

The Honourable Court in its wisdom gave judgement and held that the Prosecution proved the offence of Rape against the defendant beyond reasonable doubt.

The Judge consequently convicted the defendant and sentenced him to Life imprisonment.

Emirship tussle: Court affirms jurisdiction to hear Bayero’s rights suit

A Federal High Court in Kano, on Thursday, ruled that it has jurisdiction to hear the human rights violation case filed by the dethroned Emir of Kano, Aminu Ado Bayero, and senior councillor, Aminu Dan’agundi, following the reinstatement of Emir Muhammad Sanusi II.

The court issued an ex-parte order preventing Governor Abba Yusuf of Kano from reinstating Sanusi until a substantive suit against the reinstatement is resolved.

The order also opposed the abolishment of four emirates—Bichi, Gaya, Karaye, and Rano—under a bill previously passed by the state House of Assembly.

All parties were instructed to maintain the status quo until the suit filed by Sarkin Dawaki Babba and Aminu Babba-Dan’Agundi is determined.

Justice Liman granted the plaintiff/applicant permission to issue and serve their originating motion and other court processes to the sixth defendant (Inspector General of Police) in Abuja, and outside the court’s jurisdiction.

The defendants in the suit include the Kano State Government, the Kano State House of Assembly, the Speaker of the State Assembly, the Kano State Commissioner of Police, the Inspector General of Police, the Nigerian Security and Civil Defence Corps, and the Department of State Security.

Justice Liman said all parties are ordered to maintain status quo ante in the passage and assent of the bill.

“That parties are hereby ordered to maintain status quo ante pending hearing of the fundamental rights application.

“In view of the constitutional and jurisdictional issues apparent on the
in the face of the application, parties shall address the court at the hearing of the fundamental rights application which is fixed for the 3rd of June, 2024.

“That to maintain the peace and security of the state, an Interim Injunction of this Honourable Court is granted restraining the respondents from enforcing, executing, implementing and operationalizing the Kano State Emirate Law Council (Repeal) Law.

“That parties are hereby ordered to maintain status quo ante the passage and assent of the bill into pending the hearing of the fundamental rights application,” he said.

However, when the case resumed on Thursday, Justice Liman, relying on Section 42 Sub-section 1 of the Constitution, said the court has powers of jurisdiction to hear the case.

The judge noted, “What I find intriguing is the respondents’ total reliance on this case of Gongola, whereas Section 42 Sub-section 1 of the Constitution has clearly spelt out the jurisdictional powers of the Federal High Court to preside over such a case.

“My respectful view is that the case of Tukur against the Gongola is indistinguishable from the present case. Section 42 Sub-section 1 and Section 32 of the Constitution has vested a power on our court to decide on this matter.”

In continuation of the case the plaintiff’s counsel, Chukwuson Ojukwu, argued that the matter is ripe for hearing as to the main issues of the invalidity of the reappointment of a new Emir and the deposition of 15th Emir Aminu Ado Bayero.

But A. G Wakil insisted that the new motion seeking to continue hearing on the Chieftaincy Affairs issues was not part of the original summons and is a different application outside the matter of Human Rights Violation and the jurisdictional powers of the court, which the court had decided.

The judge explained that the matter was adjourned till Thursday, June 13, 2024, for only ruling and nothing else.

Justice Liman adjourned the case till June 14, 2024, noting that the matter was too sensitive to linger.

NYSC challenges Corps Members to utilise vocational skills for self reliance

The Kogi Coordinator of National Youth Service Corps (NYSC), Femi Osungbohun, has urged outgoing corps members to effectively utilise the acquired skills during the one year mandatory national service.

Osungbohun gave the advice during the Passing-Out-Parade (POP) ceremony for 2023 Batch ‘B’ Stream l Corps members on Thursday in Lokoja.

The POP marks the end of a year-long journey of serving the nation, which is a mandatory requirement for Nigerian graduates.

According to him, a total of 825 deserving corps members of 2023 Batch B Stream l, have successfully completed and met the necessary requirements for the one year national service to their fatherland.

Osungbohun urged the corps members to effectively utilised all the acquired skills under the NYSC Skills Acquisition and Entrepreneurship Department (SAED), to be self-reliant and employers of labour.

“I am sure with the kind of positive impacts the NYSC has made on you during your service year, don’t just sit back and expect government to do everything for you.

“Opportunities abound everywhere with your education and the various skills you have acquired.

“The hour has come when the advantages of all the NYSC SAED programmes, should live with you, because there is no white collar job anywhere.

“The skills should be able to empower you to be self employed and be employers of labour,” he said.

Osungbohun stressed that the NYSC operatives were always very happy that yet again they had been able to tutor and mentored a very critical segment of the society for nation building.

He added: “The 825 corps members that are leaving service today, we are proud to say that individually and collectively they are going out into the society to make positive impacts”.

Three worthy corps members who distinguished themselves in their various assignments during their service year, received Letters of Commendation from NYSC.

The corps members were: Serah Ogundeji – Oyo; Dr Adeniyi Ayomide – Ondo; and Hamza Babatunde from Ogun State. They all expressed their gratitude to NYSC for the opportunity to serve the nation in that capacity.

Checkpoint not responsible for Enugu-Onitsha expressway accident — Army

The Nigerian Army said the Ugwu Onyeama checkpoint was not responsible for the accident that occurred on the Enugu-Onitsha expressway on Wednesday, June 12.

The military headquarters made this clarification in a statement via its X handle @HQNigerianArmy on Thursday.

Vanguard gathered that four people were reported dead from the accident while 10 others comprising eight male adults and two females sustained different degrees of injuries.

The Army was responding to media reports that claimed its checkpoint was responsible for the accident and the loss of lives, which the Army countered by confirming only two fatalities.

The statement reads, “The attention of Headquarters 82 Division Nigerian Army has been drawn to the news circulating in some mainstream and social media platforms attributing the Division’s Checkpoint at Ugwu Onyeama as the cause of an unfortunate and tragic accident that claimed 25 lives on 11 June 2024.

“On receipt of the information from an online journalist that sought clarification about the incident, he was informed one-off that the Division does not have a checkpoint there but rather, it has a Location/Base by the roadside to curb the incessant kidnappings the area was hitherto known for.

“This report is inaccurate and full of falsehoods that are meant to tarnish the appreciable efforts of the troops. It is therefore necessary to set the records straight. First, the Division wishes to condole and commiserate with the families whose loved ones were involved in the tragic incident and also pray for the speedy recovery of those injured.

“The troops only have a base and the barriers used for the checkpoint were removed. Due to the steep gradient of the road, the section has remained problematic since the 1990s before, during, and after the checkpoints were removed.”

The Army also clarified that the accident was caused by an oncoming truck’s brake failure while descending from a slope at the 9th Mile axis ahead of the checkpoint and not at the Army’s checkpoint.

“The accident that occurred yesterday happened about 300m ahead of the soldiers’ base. Preliminary investigation revealed that the accident occurred due to a brake failure of a trailer coming downslope from 9th Mile Axis
